     >>ความเป็นมา

   พระราชบัญญัติสภาครูและบุคลากรทางการศึกษา พ.ศ. 2546 กำหนดวิชาชีพครู ผู้บริหารสถานศึกษา
และผุ้บริหารการศึกษาและบุคลากรทางการศึกษา เป้นวิชาชีพควบคุม ผุ้ประกอบวิชาชีพควบคุม
ที่จัดการศึกษาในสถานศึกษาปฐทวัย การศึกษาขั้นพื้นฐานและระดับอุดมศึกษา
ที่ตำกว่าปริญญาทั้งของรัฐและเอกชนจะต้องได้รับใบอนุญาตประกอบวิชาชีพจากคุรุสภา จึงจะมีสิทธิประกอบ
วิชาชีพได้ใบอนุญาตประกอบวิชาชีพจะเป็นหลักประกันความมีมาตรฐานและคุณภาพของการประกอบวิชาชีพ
และเป้นการยกระดับมาตรฐานวิชาชีพครูให้สูงขึ้น นอกจากนี้ข้าราชการครูและบุคลากรทางการศึกษาที่มี
ีใบอนุญาตประกอบวิชาชีพ จะได้รับเงินเดือน เงินวิทยฐานะตาม พรบ.เงินเดือน เงินวิทยฐานะ และเงินประจำ
ตำแหน่งของข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 ด้วย

>>กลุ่มผู้มีสิทธิ์ได้รับใบอนุญาตประกอบวิชาชีพ
          กลุ่มผู้มีสิทธิ์ได้รับใบอนุญาตประกอบวิชาชีพแบ่งออกเป็น 4 กลุ่ม ได้แก่
          1.ใบอนุญาตประกอบวิชาชีพครู ซึ่งออกให้กับข้าราชการครู และผู้ประกอบวิชาชีพครูโดยทั่วไป           
          2.ใบอนุญาตประกอบวิชาชีพผู้บริหารสถานศึกษา ซึ่งออกให้กับผู้อำนวยการสถานศึกษา และรองผู้อำนวยการสถานศึกษา
          3.ใบอนุญาตประกอบวิชาชีพผู้บริหารการศึกษาซึ่งออกให้แก่ผู้ที่ปฏิบัติหน้าที่อยู่นอกโรงเรียนและบุคคลที่จัดกลุ่มเป็น
เจ้าหน้าที่บริหารการศึกษาขั้นพื้นฐาน ได้แก่ หัวหน้าการประถมศึกษาอำเภอและผู้ช่วยศึกษาธิการอำเภอและผู้ช่วยเดิม จัดกลุ่มเป็นเจ้าหน้าที่บริหารการศึกษาขั้นพื้นฐาน รวมทั้งผู้อำนวยการสำนักงานเขตพื้นที่การศึกษา (สพท.) รองผอ.สพท. และผู้ช่วย
          4.ใบอนุญาตประกอบวิชาชีพบุคลากรทางการศึกษาอื่น เช่น ศึกษานิเทศก์ เป็นต้น 

>>ผู้มีสิทธิได้รับใบอนุญาตประกอบวิชาชีพทางการศึกษา

ผู้มีสิทธิได้รับใบอนุญาตประกอบวิชาชีพทางการศึกษาต้องมีคุณสมบัติ ดังนี้

  1. ให้ครูซึ่งเป็นสมาชิกของคุรุสภาตามพระราชบัญญัติครู พุทธศักราช 2488 ก่อนวันที่ 12
มิถุนายน 2546 ซึ่งเป็นวันที่พระราชบัญญัติสภาครูและบุคลากรทางการศึกษา พ.ศ. 2546 มีผล
ใช้บังคับ และผู้ที่เป็นครูก่อนวันที่ 12 มิถุนายน 2546 ซึ่งเกษียณอายุราชการไปแล้ว เป็นผู้มีสิทธิ
ได้รับใบอนุญาตประกอบวิชาชีพครู โดยื่นหลักฐานแสดงความเป็นครู และ เป็นสมาชิกคุรุสภาเพื่อ
ขอรับใบอนุญาต

    2. ให้ผู้เป็นครูหลังวันที่ 11 มิถุนายน 2546 (วันที่ 12 มิถุนายน 2546 เป็นต้นไป)
และครูอัตราจ้างที่มีวุฒิปริญญาทางการศึกษา หรือปริญญาอื่นที่ กค. กำหนดให้เป็น
คุณวุฒิที่ใช้ในการบรรจุและแต่งตั้งเป็นข้าราชการครู ก่อนวันที่ 12 มิถุนายน 2546
เป็นผู้มีสิทธิได้รับใบอนุญาตประกอบวิชาชีพครู ทั้งนี้ ภายในสามปี นับตั้งแต่วันที่
12 มิถุนายน 2546

(ผู้มีสิทธิ์ได้รับใบอนุญาตประกอบวิชาชีพครู ตามระเบียบ ข้อบังคับ

1. ครูซึ่งเป็นสมาชิกคุรุสภาตาม พ.ร.บ. ครู พ.ศ.2488 อยู่แล้ว ก่อนวันที่ 12 มิถุนายน 2546

2. ครูตามข้อ 1 ต่อมาลาออกหรือเกษียณอายุราชการหลังวันที่ 12 มิถุนายน 2546
3. ผู้บริหารสถานศึกษา ผู้บริหารการศึกษา และบุคลากรทางการศึกษาอื่น ซึ่งปฏิบัติงานในตำแหน่งอยู่ก่อน
วันที่ 12 มิถุนายน 2546
  ในวาระเริ่มแรก จนถึง 3 ปี ที่ พ.ร.บ. สภาครูและบุคลากรทางการศึกษา พ.ศ.2546 มีผลบังคับใช้
ผู้บริหารสถานศึกษา ผู้บริหารการศึกษาและบุคลากรทางการศึกษา มีสิทธิขอใบอนุญาตประกอบวิชาชีพ
ครูและใบอนุญาตประกอบวิชาชีพ ตามตำแหน่งของตนได้

4. ครูซึ่งได้รับการบรรจุแต่งตั้งให้ทำการสอนโดยได้รับเงินเดือน ตั้งแต่วันที่ 12 มิถุนายน 2546
และมีวุฒิปริญญาทางการศึกษา หรือปริญญาอื่นที่ ก.ค. กำหนดให้เป็นคุณวุฒิที่ใช้ในการบรรจุและ
แต่งตั้งเป็นข้าราชการครู
5. ครูอัตราจ้างตามสัญญาจ้างที่มีวุฒิปริญญาทางการศึกษา หรือปริญญาอื่นที่ ก.ค. กำหนดให้เป็นคุณวุฒิ
ที่ใช้ในการบรรจุและแต่งตั้งเป็นข้าราชการครู
6. ผู้ที่วุฒิปริญญาทางการศึกษาหรือปริญญาอื่นที่ ก.ค. กำหนด ให้เป็นคุณวุฒิที่ใช้ในการบรรจุและแต่งตั้ง
7. ผู้ที่ได้รับปริญญาทางการศึกษาตามหลักสูตรที่สถาบันการศึกษาเปิดสอนอยู่ ในวันที่ 12 มิถุนายน 2546
และมีอายุไม่ต่ำกว่า 20 ปี บริบูรณ์
8. ผู้ที่ได้วุฒิปริญญาทางการศึกษา หรือเทียบเท่า หรือวุฒิอื่นที่คุรุสภารับรองผ่านการปฏิบัติการสอน
ในสถานศึกษาตามหลักสูตรปริญญาทางการศึกษาเป็นเวลาไม่น้อยกว่า 1 ปี และผ่านเกณฑ์การประเมินการ
ปฏิบัติการสอนตามหลักเกณฑ์วิธีการ และเงื่อนไข ที่คณะกรรมการคุรุสภา กำหนด และมีอายุไม่ต่ำกว่า
20 ปีบริบูรณ์ และไม่มีลักษณะต้องห้าม ตามมาตรา 44 (ข) แห่ง พ.ร.บ. สภาครูและบุคลากรทางการศึกษา
พ.ศ. 2546)
>>ยกเว้นค่าธรรมเนียมขอขึ้นทะเบียนประกอบวิชาชีพ (ครูก่อน12 มิ.ย.46)
>>อัตราค่าธรรมเนียม สำหรับผู้ประกอบวิชาชีพทางการ
1. ค่าขึ้นทะเบียนรับใบอนุญาตประกอบวิชาชีพครู ฉบับละ 500 บาท
2. ค่าขึ้นทะเบียนรับใบอนุญาตประกอบวิชาชีพผู้บริหารสถานศึกษา ฉบับละ 500 บาท
3. ค่าขึ้นทะเบียนรับใบอนุญาตประกอบวิชาชีพผู้บริหารการศึกษา ฉบับละ 500 บาท
4. ค่าขึ้นทะเบียนรับใบอนุญาตประกอบวิชาชีพควบคุมอื่น ฉบับละ 500 บาท
5. ค่าต่อใบอนุญาตประกอบวิชาชีพทางการศึกษา ครั้งละ 200 บาท
6. ค่าหนังสือรับรองการขึ้นทะเบียนผู้ประกอบวิชาชีพ ฉบับละ 300 บาท
7. ค่าหนังสืออนุมัติหรือวุฒิบัตรแสดงความรู้ ความชำนาญ ฉบับละ 400 บาท
8. ค่าใบแทนใบอนุญาต ฉบับละ 200 บาท
>>ขั้นตอนการขอขึ้นทะเบียนประกอบวิชาชีพครู (คลิดดูแผนภูมิ)

     ผู้ยื่นขอใบอนุญาตฯ จะต้องจ่ายค่าธรรมเนียม 500 บาท และสามารถยื่นขอผ่านทางไปรษณีย์ได้ โดยเสียค่าเนียมรายการจำนวน 10 บาททั่วประเทศ แต่หากต้องการมายื่นด้วยตนเองที่คุรุสภาก็สามารถทำได้ สำหรับข้าราชการครูที่บรรจุใหม่จะต้องมายื่นขอใบอนุญาตฯ ที่คุรุสภาด้วยตัวเองเท่านั้น และเมื่อได้รับการตอบรับให้ได้รับใบประกอบวิชาชีพแล้ว แม้ว่าจะยังไม่ได้รับใบอนุญาตฯ ตัวจริง บุคคลดังกล่าวก็ประหนึ่งเป็นผู้มีใบอนุญาตฯ แล้ว
